Stevens on the last term

Justice Sevens said that he disagreed with the result of Kelo (interpreting the takings clause of the Fifth amendment to allow the taking of private property for private development to be a "public use") and Raich (holding Congress may prohibit intrastate production or trade in medical marijuana).
I agree with him on both counts: the government power to take property has often been abused and the government should allow medical use of marijuana, but in each case the government has the power to make the wrong decision.

Oh, those liberal activist judges, not interfering with government!
